Terms & Conditions.

These terms and conditions (“Terms”) apply to the use of saxbyryan.com and to all bookings made with Ryan Hendricks, trading as Sax by Ryan (“Ryan”, “we”, “us”), based in Cape Town, South Africa. By submitting a booking inquiry or paying a deposit, you accept these Terms.

1. Services

We offer live saxophone performances for events, one-on-one mentorship, and (coming soon) an online course. The specific services for your event are as described in your quote and invoice.

2. Bookings and quotes

Submitting a booking inquiry does not confirm a booking. After you inquire, we will send you a quote for your event. Quotes are valid for 7 days unless stated otherwise, and availability is not reserved until your deposit is paid. All prices are in South African Rand (ZAR).

3. Deposit and payment

A booking is confirmed only once a deposit of 50% of the quoted fee has been paid. On payment of the deposit, your event date is secured and blocked out in our calendar. The remaining balance is due on or before the day of the event. All payments are processed securely through PayFast; we do not see or store your card details.

4. Cancellations and rescheduling

Cancellation by you: the deposit is non-refundable. It secures your date exclusively, which means other bookings are turned away for that date. If you cancel before the event day, no further balance is payable. Amounts already paid beyond the deposit are refundable if you cancel before the event day.

Rescheduling: if you need to move your event, we will do our best to accommodate the new date. At our discretion, your deposit may be transferred once to a new date, subject to availability.

Cancellation by us: in the unlikely event that we cancel a confirmed booking, all amounts you have paid — including the deposit — will be refunded in full.

Force majeure: if an event cannot proceed due to circumstances beyond either party's reasonable control (such as natural disaster, government restriction, or serious illness), we will work with you to reschedule; if rescheduling is not possible, amounts paid will be refunded, less reasonable costs already incurred.

5. Your responsibilities

You are responsible for providing accurate event details, and for ensuring a safe, weather-protected performance area with access to power where required. If the performance cannot proceed on the day because these were not provided, the full fee remains payable.

6. Recordings and intellectual property

All content on this website — including text, images, audio, and branding — belongs to Ryan Hendricks and may not be reproduced without permission. You are welcome to record and share moments from your event for personal, non-commercial use. Commercial use of performance recordings requires prior written agreement.

7. Liability

To the maximum extent permitted by law, our total liability arising from any booking is limited to the amounts you have paid for that booking. Nothing in these Terms limits any rights you have under the Consumer Protection Act 68 of 2008 that cannot lawfully be limited or excluded.

8. Privacy

We process your personal information in accordance with our Privacy Policy and POPIA.

9. General

These Terms are governed by the laws of the Republic of South Africa, and the courts of the Western Cape have jurisdiction over any dispute. If any part of these Terms is found to be unenforceable, the rest remains in effect. We may update these Terms from time to time; the version published on this page at the time of your booking applies to that booking.
